OVERVIEW
These Terms of Service govern the use of the Grow Your Mind website, online platforms, products, services, digital content and School Program subscriptions.
By accessing our website or purchasing products or services, you agree to be bound by these Terms.
1. DEFINITIONS
“Digital Content” means all videos, lesson plans, worksheets, PDFs, animations, training materials, presentations and educational resources provided through the Service.
“School Program Subscription” means any subscription product that provides access to Grow Your Mind’s online educator platform and associated resources.
“Service” means all products, services, subscriptions, content, training and resources offered by Grow Your Mind Pty Ltd.
2. USE OF THE SERVICE
You agree to use the Service only for lawful purposes and in accordance with these Terms.
We reserve the right to suspend or terminate access where these Terms are breached.
3. SCHOOL PROGRAM SUBSCRIPTIONS
School Program subscriptions are provided for a period of twelve (12) months unless otherwise specified in writing.
Access is licensed on a per-user basis.
A separate licence must be purchased for each teacher, educator or staff member who wishes to access the School Program.
Schools must ensure that the number of active users does not exceed the number of licences purchased.
Licences are personal, non-transferable and may not be shared.
4. USER ACCOUNTS AND PASSWORDS
Users are responsible for maintaining the confidentiality of login credentials.
Passwords and accounts must not be shared.
Grow Your Mind reserves the right to investigate suspected unauthorised access or account sharing.
Where account sharing or password sharing is detected or reasonably suspected, Grow Your Mind may suspend access, require additional licences to be purchased, terminate access to affected accounts or refuse future access to the Service.
No refund is payable where access is suspended or terminated due to a breach of these Terms.
5. DIGITAL CONTENT LICENCE
Grow Your Mind grants a limited, non-exclusive, non-transferable licence to access and use Digital Content during an active subscription period.
All intellectual property rights remain the property of Grow Your Mind Pty Ltd.
Except where expressly authorised, users must not copy, reproduce, distribute, upload, sell, sublicense or otherwise share Digital Content.
6. EDUCATIONAL USE
Licensed teachers may use Digital Content for educational purposes within their school during the active subscription period.
Content may be used for classroom teaching, staff professional learning and parent communication relating to educational activities.
Content must not be shared with non-licensed users or organisations.
7. STUDENT INFORMATION
Grow Your Mind’s School Program is designed to be delivered by teachers and schools.
Grow Your Mind does not intentionally collect personally identifiable student information through the standard operation of the School Program.
Schools remain responsible for obtaining any permissions, consents or approvals required for classroom use of Grow Your Mind resources.
8. SUBSCRIPTION RENEWALS
Where a School Program Subscription is set to automatically renew, Grow Your Mind will endeavour to provide written notice at least thirty (30) days before the renewal date.
Failure to receive, review or act upon a renewal notice does not remove the customer’s responsibility to manage their subscription or cancel prior to renewal if they do not wish to continue.
School Program Subscriptions will automatically renew for successive twelve (12) month periods unless cancelled before the renewal date.
Customers remain solely responsible for monitoring renewal dates and ensuring cancellation requests are submitted before renewal if they do not wish to continue their subscription.
Except as required under the Australian Consumer Law, subscription fees and renewal fees are non-refundable once a subscription period has commenced.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
8A. LICENCE COMPLIANCE
Grow Your Mind reserves the right to review subscription usage to ensure compliance with licence limits.
Where usage exceeds the number of licences purchased, Grow Your Mind may require the purchase of additional licences and may suspend access until compliance is achieved.
9. ACCURACY OF INFORMATION
Information provided through the Service is for general educational and informational purposes only.
10. PRIVACY
Personal information is handled in accordance with the Grow Your Mind Privacy Policy and Data Protection Policy.
11. THIRD-PARTY SERVICES
The Service may contain links to third-party websites or tools. Grow Your Mind is not responsible for their operation or content.
12. TERMINATION
Grow Your Mind may suspend or terminate access immediately where a user breaches these Terms, shares accounts, exceeds licence limits, Unlawfully distributes content or attempts to bypass security measures.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Grow Your Mind excludes all warranties, representations and guarantees not expressly stated in these Terms.
Where a statutory guarantee under the Australian Consumer Law applies and cannot be excluded, Grow Your Mind’s liability is limited to the maximum extent permitted by law.
To the maximum extent permitted by law, Grow Your Mind is not liable for indirect, incidental, special, consequential or economic loss.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
14. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
15. CHANGES TO THESE TERMS
Grow Your Mind may amend these Terms from time to time by publishing updated versions on its website.
Continued use of the Service constitutes acceptance of updated Terms.
